Queensland Pool Safety Regulations

Queensland is one of the few places in all of Australia that require pools to be enclosed by a fence. This law has been around since 1975 and Queenslanders are accustomed to following this rule, especially when they live out on acres with private property lines or have neighbours who could easily see their pool from any vantage point. The standard for fencing around a swimming pool is contained in the following legislation:

  • AS1926.1 -2007 Swimming Pool Safety Part 1: Fencing for swimming pools
  • AS1926.2 -1995 Swimming Pool Safety Part 2: Location of fencing for private swimming pools
  • Queensland Development Code Mandatory Part 3.4 – Swimming Pool Barriers

These standards cover such things as the height and strength of barriers, mandatory non-climbable zones, gates with latches that must be locked for safety reasons. They apply even when a boundary fence or wall forms part of your pool barrier. If any parts are not up to code, you may need to construct an additional barrier on the inside where it is needed instead.

Some inflatable wading pools are also subject to State regulation.  An inflatable wading pool is classified as a “regulated swimming pool”:

  • if it can be filled with water to a depth of 300mm or more; or
  • it holds more than 2,000 litres of water; or
  • it has a filtration system.

All new swimming pools and spas require building approval from a Private Building Certifier. 

Queensland is the only state in Australia to require residential pools and spas be registered with an organization such as QBCC. The Pool Safety Register tracks all of Queensland’s regulated swimming facilities, making it easier for residents to find a pool that meets their needs no matter how they are classified- public or private; adults or children ; open year round, closed seasonally ,or seasonal .

Queensland Government mandates pool safety certificates for properties with pools or spas to protect the health and well-being of residents. The inspection is done by a licensed inspector, who will issue you Form 23 that’s valid one year when shared pools are involved and two years in all other cases. Once your certificate expires, a new certificate is required.

To get a certificate, pool owners need to contact an inspector who will verify the safety of their pools. Once they’re recognized as safe by inspectors with proper credentials, these people’s names and addresses are put on a state-wide list that provides easy access for future inspections from any licensed pool inspector in Australia.

Council has Licensed Pool Safety Inspectors who can conduct Pool Safety Inspections and issue Pool Safety Certificates – fees apply. Alternatively, you can engage a private Pool Safety Inspector.
